According to AJC, Georgia is considering dropping a provision in the distracted driving law that lawmakers call the “get out of jail free card.” The provision has allowed first time offenders to avoid paying fines by bringing a receipt for a hands-free phone device to court, and a judge dismissing the citation.
Initially, the provision was enacted to encourage drivers to buy hands-free technology, so as to not break the Hands-Free Georgia Act. Now, two years later, critics now argue that the provision has outlived its usefulness and the General Assembly may eliminate it as they also debate on whether to raise fines on distracted driving offenses.
