New research has revealed the states where couples regard prenups as the most necessary, with New York found to place the most importance on the agreement.
A September 2023 Harris Poll survey found that half of U.S. adults said they at least somewhat supported the use of prenups, which is up from the 42% the previous year, suggesting that they are becoming increasingly popular.
With this in mind, Orange County divorce law firm Sarieh Law Offices has identified which states residents are the keenest to put their division of assets into writing before entering into marriage.
The study analyzed over 40 different search terms related to prenuptial agreements, such as ‘prenup attorney,’ ‘prenup template’ and ‘prenup definition.’
According to the findings, New York couples are most set on having a written contract outlining financial responsibilities and protecting assets.
The state averaged 87.01 searches per 100,000 residents each month, which is 36% higher than the national average of 64.08 searches per 100,000 people.
The most popular terms residents searched for were ‘pre nup,’ ‘what is a pre nup’ and ‘prenuptial agreement,’ suggesting they are keen to find out more information about what one entails.
California residents are the second biggest believers in prenups, with 83.88 monthly searches per 100,000 people – 31% above the US average. The third is Hawaii, which is 30% higher at 83.62 monthly searches per 100,000 residents.

At the other end of the scale, couples in West Virginia appear to see prenups as the least necessary, with only 47.46 monthly searches per 100,000 people – 26% below the national average.
Kentucky had the second fewest number of searches, with 49.23 searches per 100,000 people, which is 23% less than the US average.
Mississippi had the third lowest number of searches, which was 20% below the national average, at 51.31 monthly searches per 100,000 residents.
‘Pre nups,’ ‘what is a pre nup’ and ‘prenuptial agreement’ are the three most searched for terms across the US, with 78,088, 38,563 and 26,267 average monthly searches, respectively.
This indicates that Americans are looking for a definition of what a prenup is to aid their decision on whether they want one ahead of their own marriage.

Commenting on the findings, Wail Sarieh from Sarieh Law Offices says:
“With nearly half of marriages ending in divorce, it’s no surprise that an increasing number of couples are thinking about a prenup before committing to each other.
“While, no one enters a marriage expecting to divorce, it does no harm to be prepared encase this does happen.
“It actually offers security that can relieve pressure and tension around finances during the marriage, as both parties are on the same page.
“It’s interesting to see the difference in searches from state to state, which perhaps reflects how comfortable couples are in suggesting the concept to their other half.”
