House Bill 49, a version of a bill that would outlaw the sale of marijuana pipes known as “bongs,” was approved unanimously by the House Judiciary committee on Tuesday. An amendment was added exempting traditional wooden pipes.

Current Florida law allows certain retailers to sell “bongs” if at  least 75 percent of their business comes from the sale of tobacco products or if they have less than 25 percent of “certain drug paraphernalia” sales. HB 49 would eliminate that exception and make any sale a first-degree misdemeanor. Subsequent violations would jump to a third-degree felony.

The bill is sponsored by Rep. Darryl Rouson (D) of St. Petersburg.
